TERMS AND CONDITIONS

The following terms and condition (the “Terms”) shall apply to all purchasers and users (sometimes referred to as “you” or “your”) of gift cards offered on www.wonderbox.com or GO DREAM branded gift cards offered from stores located in the United States of America (each, a “Store”) and are entered into between you and Wonderbox US Inc. (hereinafter: “GO DREAM” or the “Seller”), a Florida corporation. Your purchase, redemption and/or use of any GO DREAM gift card shall conclusively constitute your acceptance of these Terms.

1. BACKGROUND

1.1 Definitions

Seller: Wonderbox US Inc., mailing address 27 W 20th Street, Suite 800, New York, NY 10011, FEI/EIN number 47-3070147.

Purchaser: refers to the person having ordered or acquired a Gift Experience or any other Product.

User: refers to the holder of the Gift Experience/Product/Voucher.

Credit: refers to the credit issued by the Seller to the Purchaser or User’s customer account. This Credit may be issued under the conditions indicated in these Terms. This Credit can be used in one or more times, on the Website according to the conditions indicated in article 9.3.

Experience: refers to the services offered by our network of independent Third-Party Providers, in exchange for the Voucher.

Expiration Date: Subject to any applicable law, gift cards from WONDERBOX are valid until five (5) years from the date it was issued.
The availability, type, and price of the gift cards may vary over time. Gift cards redeemed more than six (6) months after purchase will be subject to the current availability of such Experience and might be subject to additional payment. A valid gift card for one GO DREAM Experience can always be exchanged for another GO DREAM Experience, except for the rules indicated in article 8.3.

Third-Party Provider(s) or Provider(s): refers to independent, third-party providers who provides one or more Experiences included in the Product.

Product(s): refers to whole products sold on the Website, whether it concerns a product of the Wonderbox brand, or GO DREAM brand such as Gift Experience, Gift Boxes, Gift Cards, or multi-brand Gift Vouchers, or any other brand.
Products can be presented in several ways, including a boxed gift card, gift envelope or directly through email as an e-gift card. WONDERBOX only sells gift cards for Experiences offered by Third-Party Providers, and WONDERBOX shall not be deemed the provider of the Experiences. When you redeem a gift card for an Experience, it shall solely constitute an agreement between you and the Third-Party Provider with respect to that Experience.
The Experience is offered in the form of a gift card, packaged in a beautiful box or a nice gift envelope, or in the form of an e-gift card delivered by email. Please note that the contractor switches from GO DREAM to the selected Providers at the time of reservation and may be subject to different tax and VAT rates.
The Product may come in a physical version (when available) or an electronic version. It is essential to print the Voucher in order to use it.
A Product over a sum of $800, purchased on or after October 18, 2022, cannot be exchanged or extended. It cannot be paid in full, or in part, with a Credit.

Voucher: refers to the voucher contained in the Product, which is given by the User to the Provider and which allows the realization of the Experience chosen on the Website.
The Gift Voucher can also take the form of an electronic ticket, or a Gift card. When the Voucher is in the form of an electronic ticket, it is essential to print the Gift Voucher to give it to the Provider on the day of the Experience.

Website: refers to the website www.wonderbox.com

Code / Discount Code / coupon code: refers to discount codes, expressed as a percentage or a flat amount, issued by the Seller and applicable on the Website for the purchase of eligible Products. For example, these could refer to Codes distributed by third parties as part of a sales operation (hereinafter: “Specific Operation”).

As a general rule, these Codes:

  • cannot be combined with each other or with another promotion or another sales operation
  • are non-transferable
  • have an expiration date
  • are never eligible for exchange or extension
  • are limited to one Code per order and per person, meaning the same person can only use a Code distributed as part of a Specific Operation once
  • require a minimum purchase amount, meaning a Code cannot be used on a Product whose price is the same as the value of the Code/
  • The above rules apply to all Codes, unless otherwise stipulated in the rules and regulations of the Specific Operation through which you obtained the Code.

    In the event of noncompliance with the terms of use of these Codes, as set out herein, or with the rules and regulations of a Specific Operation, Seller reserves the right to reject the use of these Codes and/or to deactivate any Products and/or Credits acquired through their use.

    1.2 Purpose

    The following terms and condition (the “Terms”) shall apply to all Purchasers and Users (sometimes referred to as “you” or “your”) of Products offered on the Website or gift cards branded “GO DREAM” or “WONDERBOX” offered from stores located in the United States of America (each, a “Store”) and are entered into between you and Wonderbox US Inc. (hereinafter: “WONDERBOX” or the “Seller”), a Florida corporation. Your purchase, redemption and/or use of any WONDERBOX gift card shall conclusively constitute your acceptance of these Terms.

    The Purchaser acknowledges having read the Terms prior to placing their order.

    These Terms come into force from December 12, 2022. It cancels and replaces all previous versions.

    The Seller reserves the right to modify these Terms at any time by publishing a new version on the Website. In event of modification of Terms, the applicable version is those in force on the date of the Order. A copy of which is given to the Purchaser with the email of Order confirmation.

    The temporary, or permanent, of one or more articles of the Terms by the Seller does not constitute a waiver of the other clauses of the Terms which continue to produce their effects.

2. ORDER PROCEDURES AND TERMS

2.1

The placement of an order for any of the Products sold on the Website assumes that the Purchaser has reviewed and expressly accepts these Terms, without this acceptance requiring the Purchaser’s handwritten signature.

Order placements via the Website are subject to strict compliance with the procedure described above. They are finalized online by means of a series of screens indicating the steps that the Purchaser must follow in order to confirm the order with the Seller.

2.1.1. Choice of Product

To place an order on the Website, the Purchaser must select a Product by browsing the Website. Once this choice has been made, the Purchaser must click on the “ADD TO CART” button.

2.1.2. Review of the shopping cart

The Purchaser must then review the contents of their cart (or, if applicable, continue shopping if they want to add more Products) and, if there is an option, select either the physical version or the electronic version of the Product.

If available, the Purchaser can also add “Gift options” to the cart. If they have a promo code, they can also add it at this juncture.

Once the Purchaser is satisfied with the contents of the cart, they will choose a delivery method, enter the email address where they want to receive their order confirmation and then click on the “Validate and proceed to payment” button.

2.1.3. Account login

If the Purchaser already has an account, they will need to log in, in order to finalize the order.

If the Purchaser does not have an account, they can skip this step and go directly to the next one, “Contact information and payment.”

2.1.4. Contact information and payment

The Purchaser will then enter or verify (and complete or correct, as needed) the billing address and shipping address for the Product(s).

They will then select one or more payment methods.

To confirm the order and proceed with payment, the Purchaser will need to check the box next to “I have read and expressly accept the Terms & Conditions” and then click on the “PAY NOW” button.

For online payments, the Purchaser will be redirected to a secure payment page and will receive an order confirmation email once the payment has cleared. After payment is made, the order will become final, and a contract will have been established between the parties.

The contractual information will be included in the order confirmation email.

2.1.5. Account creation

If the Purchaser does not have an account, they can create one by completing the required fields on the Website.

If the Purchaser does not want to create an account, their contact information will still be saved, in case the Purchaser returns to the Website to place an order, just like for any other Purchaser and for the same purposes.

2.2. Telephone orders

The Products can be ordered by telephone, by calling (917) 783-4626, Monday to Friday, 9AM to 7PM, or Saturday, 9AM to 5PM (ET). The contractual information will then be sent to the Purchaser in an email confirmation.

In any case, the Seller reserves the right to reject any order on legitimate grounds and, more specifically, if there is a suspicion of fraud or if the quantities ordered are abnormally high for a non-professional Purchaser.

2.3 FRAUD PREVENTION

In the context of its fraud prevention policy, the Seller reserves the right, following any order placed on the Website, to request from you any justificatory documents in order to be able to validate their order.

In this case, you will receive an email informing you that your order has been made the subject of verification and you will then be invited to forward the justificatory documents necessary for its validation.

If you fail to reply to a request of this type within a timeframe of 2 days following the request made by the Seller, this will automatically lead to the cancellation of the order concerned, without you having the possibility of making any subsequent claim on this score.

The purchase of any Product outside the Seller’s Website or official distribution network is under your sole responsibility and is at your own risk.

WONDERBOX reserves the right to deactivate these Products if they come under suspicion and/or if any criminal offence is detected, such as fraud, concealment of stolen goods, swindles.

This deactivation may not under any circumstances give rise to the payment of compensation for you / its buyer or its beneficiary. The customer accounts involved in suspected or proven violations will also be blocked temporarily or definitively.

3. PRICE

The Seller reserves the right to adjust its prices at any time. If this occurs after an order is placed, the price in effect at the time of order placement will apply.

All Product prices shall be the same, whether you purchase the Product directly through the Seller or from a Store. If you purchase your gift card on the Website, you will automatically receive an email confirmation once you have placed your order. You can view your past orders and print an invoice by logging into your customer account. You can also send a message here, and the Seller will send you a copy of your order confirmation via email.

4. PAYMENT

Payments shall be made on the Website with Visa, MasterCard, American Express, Discover, or, if the gift card was purchased in a Store, directly to the Store in which the Product was purchased.

In the event of payment by cards on the Website, the debit will be made immediately at the time of the purchase, except in the case where the customer pays by credit card.

The current price list is dependent upon the used credit card type. The charge will appear in the payment process. You have the option to refuse payment when you receive your statement. You have no deductible in the event that your card is misused. Your personal data is strictly confidential and neither the Seller nor others will get access to this data. The amount of your selected Experience is deducted only when the Products are sent from the Seller. There can never be a deduction of an amount greater than what you have authorized.

The Seller reserves the right to deactivate any Products for which the Purchaser has not paid.

5. DELIVERY

5.1

Limited quantities of the Products are issued, due to the limited capacities of the Providers and the limited period of validity of the Products.

The Products are subject to availability and to their Expiration Dates.

If an ordered Product is unavailable, the Purchaser will be notified as soon as possible and will be given the option to cancel the order.

The Purchaser may then choose to request either:

  • a refund for the price paid, within fourteen (14) days of the date on which the Purchaser notified the Seller of their decision to cancel the order; or
  • an exchange for a Product with similar characteristics and pricing. A new order will then be issued for the new Product, upon confirmation of the choice made by the Purchaser. That order will be expedited, since payment will have already been made.

If an exchange is not possible, WONDERBOX will issue a refund for the amount paid by the Purchaser. The Seller shall not be held responsible or liable if the event of a Product’s unavailability, nor will this entitle the Purchaser to claim any damages.

5.2

During the payment process, you can choose your desired delivery method. The Seller can send the purchased Product to you or directly to the recipient/User. If you place your order before 3 PM ET on a business day (Monday through Friday), the Seller will ship the purchased Product the same day that the order is received. Orders placed on weekends or holidays will be shipped on the next business day.

Physical Products will be delivered to the mailing address provided at the time of order placement.

Under no circumstances may the Seller be held responsible or liable for a delay in delivery caused by the Purchaser, i.e. if the recipient is absent at the time of delivery of the Product or in the event of entry of an incorrect address by the Purchaser when placing the order.

However, in the case of a demonstrated delay, the Seller will take appropriate action to verify and resolve any issues with the delivery or email service that may be its fault.

5.3

Delivery costs are indicated when ordering. The delivery details and costs will also be available in the Website’s FAQ.

In the case of a delay in delivery, the Seller shall not be held responsible or liable, if that delay is due to a force majeure event or to the action or inaction of the third party responsible for delivery.

The Purchaser may also choose to receive an electronic version of the Product.

5.4

Electronic versions of the Products will be sent to the email addressed provided during the order placement process. It is the Purchaser’s responsibility to then print them out.

Under no circumstances may the Seller be held responsible or liable for a delay in delivery caused by the Purchaser, i.e. in the event of entry of an incorrect address by the Purchaser when placing the order.

6. RIGHT OF WITHDRAWAL

The Seller offers a fourteen (14) day right of withdrawal from the purchase date. Within fourteen (14) days, you are entitled to a full refund for your non-redeemed Product.

To make use of this option, you must fill out a Return form on the Website. The monetary value of the Product will be returned within ten (10) days to the credit card used to purchase the Product. If you wish to get a refund for a gift card not purchased from www.wonderbox.com, please contact the Store in which the gift card was purchased. Please note that when your gift card is purchased elsewhere—not through the Website—the Store’s rules on exchanges and returns are upheld.

7. REDEMPTION OF YOUR EXPERIENCE

By logging into your customer account with your Voucher ID number and redemption code on www.wonderbox.com at "I have a Gift Card", you get access to reservation information for your purchased Experience. Each Product has a correlating personal ID number and redemption code that is generated at the time of reservation. There may be a waiting period for Experience reservations, so please reserve well in advance. Prices are subject to change after six (6) months, and all reservations are binding. Once an Experience has been reserved, it cannot be canceled or modified. You cannot exchange your Experience for another if you have already reserved it. Product must be brought to the Experience location. Otherwise, you may be charged and/or will be rejected on site.

8. EXCHANGE AND EXTENDING

8.1 EXCHANGING A PRODUCT

You can exchange your Product for another Experience our Website free of charge within the Product’s validity period. You can exchange a Product by following the instructions and the form at www.wonderbox.com/recipient/register.

Under no circumstances can this be a refund.

Your right of cancellation and your right to exchange lapse if you have already reserved your Experience, bought other Experiences for the same day or have Experiences with special conditions (e.g. buying the physical Products Cinema). If an Experience has restrictions, this will always be specified separately on our Website.

If you meet follow the conditions required and terms of exchange, you will receive an email informing you of the generation of a Credit corresponding to the value of the exchanged Product(s), with the exception of Products that have benefited from customization fees. In this case, the Credit will be credited with the amount of the Product, less customization costs.

8.2 EXTENDING A PRODUCT (WITHIN THE VALIDITY PERIOD)

It is possible to extend your Product by logging in to your personal access on the Website, clicking on "My Gift Card" and "Extend validity" only during the validity period of the Product. Please note that your Product must be registered in order to extend it. If you have any questions about extending a Product, please email us here or at [email protected]

If you meet the conditions to benefit from the extension, you will receive an email informing you of the generation of a Credit corresponding to the value of the extended Product.

8.3 SPECIFIC CASE

8.3.1 Products over a sum of $800

A Product over a sum of $800, purchased on or after October 18, 2022, cannot be exchanged or extended.

9. TERMS OF USE OF PRODUCTS AND LIABILITY

9.1 Terms of Use

9.1.1. Each Voucher is valid for a single activity presented on the Website.

The Products will be valid through the Expiration Date indicated on the Voucher. After that date, no exchanges or extensions will be possible.

The Provider may ask the User to pay a tourist tax on the day of the Experience.

9.1.2

The Provider may ask the User to send it the Voucher, in order to confirm the reservation. In that case, it is strongly recommended that the User send the portion of the Voucher meant for the Provider, and containing the User’s contact information, with acknowledgment of receipt. The User must then keep the part of the Voucher containing its unique number, the Expiration Date and the name of the Product. Neither WONDERBOX nor the Provider may be held responsible or liable if the Product is lost in the mail.

With regard to Experiences offered by the Provider Hôtel Express, reservations are to be made directly via the Hôtel Express website, after the User has registered the Product on the Website. Once the User selects and confirms the Hôtel Express Experience, the User will receive a reservation confirmation by email, sent directly by Hôtel Express.

9.1.3

Given the long period of validity of the Products, it is possible that the details of the Experiences and/or the list of Providers may be redefined, in which case, WONDERBOX shall not be held responsible or liable. Likewise, the ratings of the Provider’s establishments are subject to change over the course of the period of validity of the Products.

So, when reserving an Experience, it is the User’s responsibility to verify the exact details of the Experience and the list of the different Providers. Given the active role of the User in selecting both a Provider and the date of the Experience, as well as the independence of the Providers with regard to WONDERBOX, the latter shall not be held responsible or liable for any unavailability of an Experience on the User’s chosen date, including unavailability caused by technical issues. It is recommended that the User should reserve an Experience as early as possible, to ensure they have access to a broad selection of dates.

9.1.4

A reservation may not be canceled or postponed without the direct agreement of the Provider.

In particular, it is specified that the Experiences offered by the Provider Hôtel Express cannot be modified or refunded after the User has confirmed them.

9.1.5

The Experiences do not include travel to the meeting point at the chosen Provider’s location or an Internet connection in the case of an online Experience.

9.1.6

The User will not be entitled to a refund if a Voucher is not used or is lost or destroyed. WONDERBOX reserves the right not to accept complaints regarding a Product acquired by a Purchaser and/or a User outside the normal WONDERBOX Product distribution network, including if acquired from another private individual. The Purchaser/User should keep the proof of purchase in case there is a problem activating a Product. In the event of such a problem, the Purchaser/User should check the validity and status of the Product directly on the Website.

9.1.7

Please note that participation in some of the Experiences associated with risk of injury. Participation in these Experiences is at your own risk. WONDERBOX is not responsible for any injury or damage sustained from participating in these Experiences. Some of the Third-Party Providers will provide an insurance option, but you should always check your own insurance before participating in an Experience.

9.2

Notwithstanding anything to the contrary, WONDERBOX and its affiliates and their officers, representatives, agents, contractors and employees shall not be responsible or liable with respect to any subject matter of these terms, or any terms and conditions related thereto, under any contract, negligence, strict liability or other theory: (a) for any Purchaser’s or User’s use of the Product, their participation in any Experience or their redemption of the Product for any product or Experience offered by the Third-Party Providers, or any damages or liability related to or arising out of any of the foregoing; (b) for any indirect, exemplary, incidental, special or consequential damages or for loss of profit or income; (c) for any matter beyond WONDERBOX’s reasonable control; or (d) for any amounts that, together with amounts associated with all other claims, exceed the price paid for the Product, in each case, whether or not Purchaser or Store has been advised of the possibility of such damages.

If you have had a negative experience with one of our Third-Party Providers, WONDERBOX cannot be held liable for this. Any damage or harm is subject to the Third-Party Provider’s liability limitations. In the event that you wish to file a complaint, please contact the Third-Party Providers directly. However, if you do have an unsatisfactory experience, please make WONDERBOX aware of this so that WONDERBOX can assist in any future complaints. By law, you must contact WONDERBOX within a reasonable time after you have had a negative experience; it is recommended that you contact WONDERBOX immediately after redemption.

Neither WONDERBOX nor the Third-Party Provider shall be held liable for an amount greater than Product value.

9.3 Conditions of use of Credit

9.3.1

The validity period of the Credit is six (6) months from the date of issue. The Credit is forfeited if it has not been used during its period of validity because it cannot be extended under any circumstances.

9.3.2

The Credits will be usable only on our Website and will give the right to a Product in electronic version.

However, you can choose to buy a Product in physical version by paying an additional $10 per Product. This supplement can be paid with a Credit or Debit card. The acquisition of a Product in a physical version will not be possible for Products that only exist in an electronic version.

The Validity Period of the Product purchased with the Credit, will be the one indicated when purchasing the Product.

9.3.3

When several Credits are generated in your customer account, the amount of each Credit will accumulate to form a single pot, the amount of which is divisible. However, the validity date of each Credit runs from its own date of issue.

The Credit can be used in several installments during its validity period if the amount of the Product is less than the amount of the Credit. In this case, the amount of the Credit greater than the amount of the Product will automatically remain recorded in your account. If the amount of the Credit is insufficient compared to the amount due for the purchase of the Product, you must complete the payment with one of the above-mentioned payment methods.

As part of the fight against fraud, payment by Credit, in whole or in part, is unavailable for any order with a value greater than $500. In order to use the Credit, the Purchaser must, during payment, check the box offering to use their Credit.

The Credit cannot be combined with a promotion, promotional code or discount code.

As an exception, the Credit issued from an exchange will be valid for a period equal to the remaining period of validity of the Product subject to the exchange procedure and will have a minimum validity period of six (6) months from its issue.

10. RESTRICTIONS AND DISCLAIMER OF WARRANTY

10.1. Restrictions

Some Experiences are subject to certain conditions related to the User’s health, age, weight, or skill level. Those conditions are stated on the Website for each Experience and on the description of each Product.

The User agrees to carefully read through those restrictions.

The Providers reserve the right to refuse the requested Experience if the User does not meet the required conditions.

Other Experiences are only available in certain technical, weather and other conditions. Those conditions are stated for each Experience, in the description or on the Website. The Providers reserve the right to refuse the requested Experience or postpone the reservation if the required conditions have not been met.

Due to the nature of certain Experiences, certain Providers may ask the User to sign a waiver of liability or provide a deposit.

In none of these circumstances will WONDERBOX have an obligation to compensate the Purchaser/User.

The Products may include or provide access to certain products or goods. The User should read their labels carefully, in order to prevent any risks associated with those products or goods, especially the risk of allergy.

10.2. Disclaimer of warranty

The Experiences do not include travel to the meeting point at the chosen Provider’s location or an Internet connection in the case of an online Experience.

The Experiences are subject to the chosen Provider’s contractual terms and conditions, particularly with regard to reservations, cancellations and any applicable rules. It is the responsibility of the Purchaser/User to review these before requesting a reservation.

In particular, it is specified that the Experiences offered by the Provider Hôtel Express cannot be modified or refunded after the User has confirmed them.

The Provider alone is responsible for the fulfillment of the Experience.

For any requests related to the chosen Provider’s contractual terms and conditions, the User should contact that Provider directly and may not file a complaint on this subject against the Seller.

The User should contact the Provider directly to request any additional Experiences not included in the Voucher, which will then be governed by the Provider’s contractual terms and conditions.

WONDERBOX shall not be held responsible or liable in the event of the loss, theft or return of the Voucher after delivery of the Product or in the event of the User’s inability to engage in certain activities, owing to the action or inaction of the Purchaser and/or the User.

10.3. Restrictions and warranties for other WONDERBOX brands:

Products that do not fall under the WONDERBOX or GO DREAM brands may entail additional restrictions, which are accessible on the websites indicated at the time of purchase.

11. INTELLECTUAL PROPERTY RIGHTS

The elements that appear on the Website (namely including brand names and all illustrations, images, logos and photographs), which are the exclusive property of the Seller, are protected by copyright, trademark law and patent law. Any full or partial reproduction, modification or use of those brand names, illustrations, images and logos, regardless of the reason or the medium employed, is strictly prohibited without the express, prior authorization of the Seller. The same applies to any combinations or convergences with any other brand names, symbols, logos or, more generally, any distinctive signs intended to form a composite logo. Likewise, the same will apply to any copyrights, drawings, models and patents that are the property of the Seller.

13. COMPLAINTS AND RESPONSIBILITY

13.1 COMPLAINTS

Any complaint must be sent to Customer Service by email via the contact form available on the Website, as soon as possible.

13.2 DISPUTES

In the absence of an amicable resolution to any disputes arising between the Seller and the Purchaser/User, the first mover must send a formal notice to the other party, stating their grievances, prior to bringing the matter before a court.

In the case of a dispute related to the interpretation or execution of these Terms, the competent court will be the one identified by the application of the rules of common law.

These Terms are governed by the law of the State of Florida.
