TERMS AND CONDITIONS

The following terms and condition (the “Terms”) shall apply to all purchasers and users (sometimes referred to as “you” or “your”) of gift cards offered on www.godream.com or GO DREAM branded gift cards offered from stores located in the United States of America (each, a “Store”) and are entered into between you and Go Dream Inc. (hereinafter: “GO DREAM” or the “Seller”), a Florida corporation. Your purchase, redemption and/or use of any GO DREAM gift card shall conclusively constitute your acceptance of these Terms.



1. BACKGROUND AND ORDER

On www.godream.com, you can buy gift cards for various products and/or services offered by our network of independent, third-party providers (“Third-Party Providers”) (such products and/or services offered by the Third-Party Providers hereinafter referred to as an “Experience”). These gift cards can be presented in several ways, including a boxed gift card, gift envelope or directly through email as an e-gift card. GO DREAM only sells gift cards for Experiences offered by Third-Party Providers, and GO DREAM shall not be deemed the provider of the Experiences. When you redeem a gift card for an Experience, it shall solely constitute an agreement between you and the Third-Party Provider with respect to that Experience.

At www.godream.com you can buy gift cards for experiences. The experience is offered in the form of a gift card, packaged in a beautiful box or a nice gift envelope, or in the form of an e-gift card delivered by email. The GO DREAM Gift Card is a multi-purpose gift card and can be used in all the countries GO DREAM is represented in. A multi-purpose gift card is a gift card that can be used in countries with different tax and VAT rates. Please note that the contractor switches from GO DREAM to the selected providers in the booking moment and may be subject to different tax and VAT rates.

2. DELIVERY

During the payment process, you can choose your desired delivery method. GO DREAM can send the purchased gift card to you or directly to the recipient/beneficary. If you place your order before three (3) PM EST on a business day (Monday through Friday), GO DREAM will ship the purchased gift card the same day that the order is received. Orders placed on weekends or holidays will be shipped on the next business day.

3. ORDER PROCEDURES AND TERMS

PRICES

All GO DREAM gift card prices shall be the same, whether you purchase the gift card directly through GO DREAM or from a Store. If you purchase your gift card on www.godream.com, you will automatically receive an email confirmation once you place your order. You can view your past orders and print an invoice by logging into your GO DREAM account. You can also send a message here, and GO DREAM will send you a copy of your order confirmation via email.

FRAUD PRENVENTION

In the context of its fraud prevention policy, the Seller reserves the right, following any order placed on the site, to request from you any justificatory documents in order to be able to validate their order.

In this case, you will receive an email informing you that your order has been made the subject of verification and you will then be invited to forward the justificatory documents necessary for its validation.

If you fail to reply to a request of this type within a timeframe of 2 days following the request made by the Seller, this will automatically lead to the cancellation of the order concerned, without you having the possibility of making any subsequent claim on this score.

The purchase of any product outside the Seller’s Website or official distribution network is under your sole responsibility and is at your own risk.
GO Dream reserves the right to deactivate these Products if they are come under suspicion and/or if any criminal offence is detected, such as fraud, concealment of stolen goods, swindles.
This deactivation may not under any circumstances give rise to the payment of compensation for you / its buyer or its beneficiary. The customer accounts involved in suspected or proven violations will also be blocked temporarily or definitively.

5. GIFT VALIDITY

Subject to any applicable law, gift cards from GO DREAM are valid until five (5) years from the date it was issued.

The availability, type, and price of the gift cards may vary over time. Gift cards redeemed more than six (6) months after purchase will be subject to the current availability of such Experience and might be subject to additional payment. A valid gift card for one GO DREAM Experience can always be exchanged to another GO DREAM Experience.

6. RETURN POLICY

GO DREAM has a fourteen (14) day return policy on all purchases. Within fourteen (14) days, you are entitled to a full refund for your non-redeemed gift card.

7. REDEMPTION OF YOUR EXPERIENCE

By logging into your GO DREAM account with your gift card ID number and redemption code on www.godream.com at Activate Your Gift Card, you get access to booking information for your purchased Experience. Each gift card has a correlating personal ID number and redemption code that is generated upon booking. There may be a waiting period for Experience reservations, so please reserve well in advance. Prices are subject to change after six (6) months, and a booking is binding. Once an Experience has been booked, it cannot be canceled or modified. You cannot exchange your Experience for another if you have already booked it. Gift cards must be brought to the Experience location. Otherwise you may be charged and/or will be rejected on site.

8. PAYMENT

Payments shall be made on www.godream.com with Visa, MasterCard, American Express, Discover, JCB, Diners Club, echeck or, if the gift card was purchased in a Store, directly to the Store in which the gift card was purchased.

In the event of payment by cards on the site www.godream.com, the debit will be made immediately at the time of the purchase, except in the case where the customer pays by credit card.

The current price list is dependent upon the used credit card type. The charge will appear in the payment process. You have the option to refuse payment when you receive your statement. You have no deductible in the event that your card is misused. Your personal data is strictly confidential and neither GO DREAM nor others will get access to this data. The amount of your selected Experience is deducted only when the gift cards are sent from GO DREAM. There can never be a deduction of an amount greater than what you have authorized.

9. EXCHANGE OF EXPERIENCE

EXCHANGING A PRODUCT

You can exchange your Product for another experience at GO DREAM www.godream.com free of charge within the Product’s validity period. You can exchange a Product by following the instructions and the form at www.godream.com/recipient/register

Under no circumstances can this be a refund.

Your right of cancellation and your right to exchange lapse if you have already booked your experience, bought experiences for the same day or have experiences with special conditions (e.g. buying 'Cinema Trip 1' or 'Cinema Trip 2' for yourself). If an experience has restrictions, this will always be specified separately in GO DREAM www.godream.com/customer-service.html?contactFormOpen=true exchange service.

If you meet follow the conditions required and terms of exchange, you will receive an email informing you of the generation of a Credit corresponding to the value of the exchanged Product(s), with the exception of Products that have benefited from customization fees. In this case, the Credit will be credited with the amount of the Product, less customization costs.

EXTENDING A PRODUCT (WITHIN THE VALIDITY PERIOD)

It is possible to extend your Product by sending a message to Customer Service within the Product’s validity period. Messages may be sent via e-mail or phone. Customer Service must be informed before expiry, since an expired gift card cannot be reactivated. For queries regarding extending Product, please write to us to us here or on customerservice@godream.com.

If you meet the conditions to benefit from the extension, you will receive an email informing you of the generation of a Credit corresponding to the value of the extended Product.

Credit

The validity period of the Credit is six (6) months from the date of issue. The Credit is forfeited if it has not been used during its period of validity because it cannot be extended under any circumstances.

The Credits will be usable only on the Site and will give the right to a Product in electronic version.

However, you can choose to buy a Product in physical version by paying an additional $10 per Product. This supplement can be paid with a Credit. The acquisition of a Product in a physical version will not be possible for Products that only exist in an electronic version.

For Products with personalization in the physical version, a personalization fee will be added to the supplement of $10, the amount of which will be indicated during the purchase.

The Validity Period of the Product purchased with the Credit, will be the one indicated when purchasing the Product.

When several credits are generated in your account, the amount of each Credit will accumulate to form a single pot, the amount of which is divisible. However, the validity date of each Credit runs from its own date of issue.

The Credit can be used in several installments during its validity period if the amount of the Product is less than the amount of the Credit. In this case, the amount of the Credit greater than the amount of the Product will automatically remain recorded in your account. If the amount of the Credit is insufficient compared to the amount due for the purchase of the Product, you must complete the payment with one of the above-mentioned payment methods.

As part of the fight against fraud, payment by Credit, in whole or in part, is unavailable for any order with a value greater than $500. In order to use his credit, the Buyer must, during payment, tick the box offering to use his credit.

The Credit cannot be combined with a promotion, promotional code or discount code.

As an exception, the Credit issued from an exchange will be valid for a period equal to the remaining period of validity of the Product subject to the exchange procedure and will have a minimum validity period of six (6) months from its issue.

10. LOST OR STOLEN GIFT CARD

As a holder of the gift card you are responsible for any misuse or unauthorized use of the gift card. GO DREAM offers to replace a gift card if you can provide receipt for purchase and gift card number and the gift card has not been redeemed. Please contact GO DREAM as soon as you discover that the gift card has been lost or stolen.

11. RIGHT OF WITHDRAWAL

GO DREAM offers a fourteen (14) day right of withdrawal from the purchase date. To make use of this option, you must fill out a Return form on www.godream.com. The monetary value of the Experience will be returned within ten (10) days to the credit card used to purchase the gift card. If you wish to get a refund for a gift card not purchased from www.godream.com, please contact the Store in which the gift card was purchased. Please note that when your gift card is purchased elsewhere—not through www.godream.com—the Store’s rules on exchanges and returns are upheld.

12. COMPLAINTS AND RESPONSIBILITY

If you have had a negative experience with one of our Third-Party Providers, GO DREAM cannot be held liable for this. Any damage or harm is subject to the Third-Party Provider’s liability limitations. In the event that you wish to file a complaint, please contact the Third-Party Providers directly. However, if you do have an unsatisfactory experience, please make GO DREAM aware of this so that GO DREAM can assist in any future complaints. By law, you must contact GO DREAM within a reasonable time after you have had a negative experience; it is recommended that you contact GO DREAM immediately after redemption. Neither GO DREAM nor the Third-Party Provider shall be held liable for an amount greater than GO DREAM’s gift card value.

13. SAFETY

Please note that participation in some of the Experiences associated with risk of injury. Participation in these Experiences is at your own risk. GO DREAM is not responsible for any injury or damage sustained from participating in these Experiences. Some of the Third-Party Providers will provide an insurance option, but you should always check your own insurance before participating in an experience.

14. LIMITATION OF LIABILITY

Notwithstanding anything to the contrary, GO DREAM and its affiliates and their officers, representatives, agents, contractors and employees shall not be responsible or liable with respect to any subject matter of these terms, or any terms and conditions related thereto, under any contract, negligence, strict liability or other theory: (a) for any purchaser’s or user’s use of the gift cards, their participation in any experience or their redemption of the gift cards for any product or services offered by the third-party providers, or any damages or liability related to or arising out of any of the foregoing; (b) for any indirect, exemplary, incidental, special or consequential damages or for loss of profit or income; (c) for any matter beyond GO DREAM’s reasonable control; or (d) for any amounts that, together with amounts associated with all other claims, exceed the price paid for the gift card, in each case, whether or not purchaser or store has been advised of the possibility of such damages.
